From Church V. Fenton (this is very important and that is why I’m reposting) 3 types of land

Held, affirming the judgment of the Court below [1], that upon the lands in question being surrendered to the Crown, they became ordinary unpatented lands, and upon being granted became liable to assessment.

What this means is there are 3 categories of land:

1) lands in question being surrendered to the Crown These would be Native Lands

2) ordinary unpatented lands These would be Crown lands

3) upon being granted became liable to assessment These would be patented lands

Only patented lands pay taxes: no patents, no land taxes
